In the wake of the financial crisis many people have found themselves in impossible financial positions. For the first time there are a large number of people with relatively low income and relatively low debts struggling to meet their financial obligations. For this reason the government introduced Debt Relief Orders in April this year. They are intended to have the same effect as bankruptcy, but are designed for people with low levels of debt and income. At present there are only six organisations who are approved to offer DROs, and only one commercial organisation. If you cannot pay your debts and if these debts do not exceed ?15,000 you may qualify for a DRO. There are also other conditions such as the level of your disposable income must not exceed ?50 a month one all household expenses have been considered. Of course, even being insolvent is not free, and just like bankruptcy, DROs carry a charge. The charge for a DRO, however, is about one fifth of that for bankruptcy. Just like bankruptcy, a DRO will remain on public record for 15 months and on your credit record for 6 years. During the period of the DRO you will not be able to apply for more than ?500 credit without informing the prospective lender, nor will you be able to trade under any name or company name other than that associated with the DRO. There is no such thing as a benefit of an insolvency order, but the effects of a DRO are broadly similar to those of bankruptcy. Accordingly, when you apply for a DRO you are declaring your inability to pay your creditors, it is, and should only be, a last resort. Any insolvency declaration is long lasting and can have a serious impact on you for many years. For that reason it's important to get advice if you find yourself in such a situation that a DRO is worth considering. Accordingly, a DRO is a serious decision, any insolvency declaration is, and it's not a decision that you should make without getting a lot of advice. The Citizens Advice Bureau is, as ever, a good source of information, as are the other companies that provide the service.
